By accessing or using the Services, you agree to be bound by these Terms.
Use of Services
You may use our Services only if you can form a binding contract with Pacefyx and are not a person barred from receiving services under the laws of the applicable jurisdiction. You may use the Services only in compliance with these Terms and all applicable local, state, national, and international laws, rules, and regulations.
The Services that Pacefyx provides are always evolving and the form and nature of the Services that Pacefyx provides may change from time to time without prior notice to you. In addition, Pacefyx may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally and may not be able to provide you with prior notice.
Google Workspace Compliance
Our Services are built for the Google Workspace platform and are hosted entirely on Google infrastructure. We comply with Google Workspace policies, requirements, and guidelines, including Google's API Services User Data Policy. You agree to use our Services in accordance with Google Workspace policies and requirements.
Content on the Services
All Content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such Content. We may not monitor or control the Content posted via the Services and, we cannot take responsibility for such Content. Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk.
Intellectual Property Rights
All rights, title, and interest in and to the Services (excluding Content provided by users) are and will remain the exclusive property of Pacefyx and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Nothing in the Terms gives you a right to use the Pacefyx name or any of the Pacefyx trademarks, logos, domain names, and other distinctive brand features.
Third-Party Links and Services
The Services may contain links to third-party websites or services that are not owned or controlled by Pacefyx. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Pacefyx shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
Termination
We may terminate or suspend your access to the Services at any time, with or without cause or notice, effective immediately. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services.
Limitation of Liability
In no event shall Pacefyx, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.
Changes to the Terms of Use
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
